中国推进地理标志产品保护示范区筹建

  29! That is the number of national GI (geographical indication) protection demonstration areas (GI areas) to be set up in the next three years, according to a 2022 list announced in October by the China National Intellectual Property Administration (CNIPA).

  In 2010, China commenced the construction of the national GI (appellations of origin) areas nationwide. In 2018, pursuant to a relevant reform plan of the State Council, the restructured CNIPA inherited all the GI-related missions including the aforementioned construction.

  Construction of the GI areas is an effective tool for China to further refine its GI protection system and control the quality of GIs. In February 2021, CNIPA enacted the Measures on Administration of the Construction of the Geographical Indication Protection Demonstration Areas (Trial), offering clear guidance to the construction. In October 2021, in the 14th Five-Year National Plan for IP Protection and Application, the State Council mandated the completion of 100 GI areas during the 14th five-year period.

  "As of now, China has set up 103 GI areas," a CNIPA principal in charge of the IP protection department introduces that such construction may not only ensure quality control of GI products and give them a competitive edge on the market, but also bring the entire supply chain on board, both upstream and downstream sectors, and boost the economy of relevant regions.

  In an effort to secure sustainable construction of the GI areas, in October 2022, CNIPA released the Notice on Identifying the 2022 List of the Construction of the Geographical Indication Protection Demonstration Areas, demanding provincial IP administrations to instruct the task executors to do the work properly. The specific requirements include strict GI protection, principles of high standard construction, high level protection, high quality development, innovative approach, enactment of accompanying policies, offering of dedicated resources to solidifying resources, improving operational protocols, heightening protection, strengthening publicity on protection, bolstering cooperation and win-win.

  "The 29 areas of this year are diverse in product types, reputable and profitable," a CNIPA principal elaborates that the GI products from the 29 areas cover agricultural, forest products, traditional Chinese medicine materials as well as food and handicrafts. They are both diverse in product types and famous. Zhenjiang Vinegar, Xinyang Maojian Tea, Liuzhou Luosifen (river snails rice noodles) are all popular brands in China and even worldwide.

  When the GI power directs inward, it assists rural revitalization. When it points outward, it helps exploring markets overseas. The 29 areas do not only represent GI products vital for rural revitalization, but products mutually recognized for protection under the China-EU GI protection and cooperation agreement.

  "The interest of this year's area construction is in rural revitalization. The 29 areas span 15 middle and western provinces, hosting three national key rural revitalization go-to counties. Their GI products boast high economic value. Inside these areas, 874 companies are using GI special symbols, generating combined annual earnings of 58.94 billion yuan. Wine in Helan Mountain East Region and Huanggang Wickerwork are among the high value-added products," the principal adds.

  Wine in Helan Mountain East Region is both a GI product and a registered GI certification mark. "The selection into the GI area list is a breakthrough for the brand development of Wine in Helan Mountain East Region, which will give a big push for further ramping up its brand value and market impact," an official of the Ningxia (Hui Autonomous Region) Administration for Market Regulation (Intellectual Property Administration) claims that Ningxia will take advantage of the area construction, follow the principles of high standard construction, high level protection, high quality development, intensify protection and management of Wine in Helan Mountain East Region, steer the development of the wine to the high-end and international path.

  The construction of GI areas is under way to graduate once mere local specialties to profitable industries: in Ningxia, the 'purple industry' realized by Wine in Helan Mountain East Region has given a sense of wellbeing to the western population; in Guangxi, the 'influencer industry' fed by Liuzhou Luosifen has unlocked the code to wealth for the southern border province. Piloted by these demonstration areas, more and more villages nationwide are invoking the GI toolkit to become affluent, painting an infinite picture of rural revitalization.  (by Feng Fei/Tian Shuming)

  29个!今年10月,中国国家知识产权局发布了2022年国家地理标志产品保护示范区筹建名单,将筹建29个示范区,筹建期为3年。

  2010年,中国在全国范围内启动了国家地理标志产品保护示范区建设工作。2018年,根据中国国务院机构改革方案有关要求,重新组建的中国国家知识产权局负责包括国家地理标志产品保护示范区建设管理在内的原产地地理标志相关工作。

  建设保护示范区是中国进一步完善地理标志保护体系,严格地理标志特色质量监管的有效抓手。2021年2月,中国国家知识产权局出台《国家地理标志产品保护示范区建设管理办法(试行)》,为示范区建设管理工作提供了明确指引。2021年10月,中国国务院印发的《“十四五”国家知识产权保护和运用规划》提出,“十四五”期间,中国要建成100个国家地理标志产品保护示范区。

  “截至目前,中国已建设103个国家地理标志产品保护示范区。”中国国家知识产权局知识产权保护司有关负责人介绍,示范区建设不仅有利于保护地理标志产品质量、提升产品市场竞争力,还可以带动全链条上下游产业发展,促进区域经济效益提升。

  为持续做好示范区建设工作,今年10月,中国国家知识产权局印发《关于确定2022年国家地理标志产品保护示范区筹建名单的通知》,要求省级知识产权管理部门指导各示范区建设承担单位做好相关工作,尤其是聚焦严格地理标志保护,按照高标准建设、高水平保护、高质量发展的工作原则,创新工作方式,研究出台配套政策,在夯实保护制度、健全工作体系、加大保护力度、强化保护宣传和加强合作共赢等方面集中资源予以重点专项支持。

  “今年筹建的29个示范区,呈现保护种类多、产品知名度高、综合效益好三大特点。”上述负责人介绍,29个示范区内的地理标志产品既涵盖农林产品、中药材,又包括食品、手工艺品等,产品种类非常丰富,且拥有较高知名度,比如镇江香醋、信阳毛尖、柳州螺蛳粉等,都是在中国甚至全球范围内广受消费者欢迎的产品。

  对内助力乡村振兴,对外开拓海外市场。今年开始筹建的29个示范区不仅遴选了在乡村振兴中发挥重要作用的地理标志产品,还对入选中欧地理标志保护与合作协定互认互保名录的产品予以支持。

  “今年的示范区建设聚焦乡村振兴,29个示范区覆盖15个中西部省份,涵盖3个国家乡村振兴重点帮扶县。纳入示范区筹建名单的地理标志产品均具有较高经济效益,已有874家企业使用地理标志专用标志,直接年产值达589.4亿元,其中包括贺兰山东麓葡萄酒、黄岗柳编等多个具有高附加值的产品。”中国国家知识产权局知识产权保护司有关负责人介绍。

  贺兰山东麓葡萄酒既是地理标志保护产品,同时也注册了地理标志证明商标。“此次入选示范区筹建名单,是贺兰山东麓葡萄酒地理标志品牌建设的一次突破性进展,对进一步提升贺兰山东麓葡萄酒品牌价值、扩大市场影响力将起到重要推动作用。”宁夏回族自治区市场监督管理厅(知识产权局)有关负责人表示,下一步,宁夏将以示范区建设为契机,按照高标准建设、高水平保护、高质量发展工作原则,进一步强化贺兰山东麓葡萄酒地理标志产品保护和管理,推动贺兰山东麓葡萄酒产业走上高端化、国际化发展道路。

  让特色产业成为富民产业,国家地理标志产品保护示范区建设已然在路上:在中国宁夏,依托贺兰山东麓葡萄酒打造的“紫色产业”为塞上儿女“酿”出了美好生活;在中国广西,依托柳州螺蛳粉打造的“网红产业”为八桂大地开启了致富密码……在保护示范区的示范引领下,一幅幅依靠地理标志增收致富的乡村振兴画卷正在中国各地徐徐展开。(冯飞 田树明)
